Another CHILD STOLEN for Prison Profit!

 

 

To: President Obama, California Governor Jerry Brown,Attorney General,District Attorney : Familes with children,teens or young adults who lives were stolen.

We, the friends, family and supporters of Christy Phillips, an innocent woman serving Life Without The Possibility of Parole (LWOP), are requesting that Governor Jerry Brown review the merits of her case as it is riddled with numerous Constitutional and Miranda rights violations. 28 year old Christy is entering her 13th year of LWOP which she unjustly received in 2002 at the age of 16 for the murder of an elder woman in San Bernardino, California.  

The conviction was solely based on a coerced false videotaped confession illegally obtained by authorities. The false confession was the only “evidence” the prosecution had.
There was no physical evidence, forensics or DNA linking Christy to the crime.

There were partial fingerprints discovered at crime scene that did not match Christy's but this information was not divulged to the jury.

There was evidence found at crime scene that was never tested for DNA or submitted into evidence.
There was a person at the scene of the crime who was never charged.
Christy received ineffective counsel due to her public defender not raising the issue of the violation of her Miranda Rights which would have required the suppression of the coerced false videotaped confession that was illegally obtained by authorities.

Christy was denied the right to have a parent or legal counsel present during her interrogation.

It is also important to note that Christy was 15 years old at the time of questioning by officers and was suffering from mental disabilities.
During jury instructions, Juror #2, stated that she was good friends with one of the officers who was involved in Christy's case and slated to testify in her trial. The officer and other detectives involved in the case were members of Juror #2's church. This juror should have been dismissed due to conflict of interest. 
The gravity of the legal violations raised in this petition can no longer be ignored. Christy's case warrants serious review. After 13 years of being locked up for a crime she did not commit, it is time that Christy receive justice.
We are requesting she receive clemency or immediate parole.

In their Government class, students learned various aspects of the criminal justice system, with a focus on understanding how Court precedents influence the interpretation of the Constitution. They chose a specific research topic related to issues surrounding Mass Incarceration (the phenomenon where large segments of U.S. society - 2.4 million total - are currently behind bars), such as "Stop & Frisk" policies, Private Prisons, Incarcerated Women, the War on Drugs, Juvenile Justice, and Immigration Detention. After creating individual fliers on their topic, students were grouped together, and given the task of creating a 4-5 minute film.

Cyntoia Brown Life begins at 16

 
In 2004, Cyntoia Brown was arrested for murder. There was no question that a 43-year-old man is dead and that she killed him. What mystified filmmaker Daniel Birman was just how common violence among youth is, and just how rarely we stop to question our assumptions about it. He wondered in this case what led a girl — who grew up in a reasonable home environment — to this tragic end?Me Facing Life: Cyntoia’s Story explores Cyntoia’s history and her future. Without attempting to excuse her crime as youthful indiscretion nor to vilify her as an example of a generation gone off the rails, Birman simply follows Cyntoia through six years of her life after the crime, and searches for answers to persistent questions.The camera first glimpses Cyntoia the week of her arrest at age 16 and follows her for nearly six years. Along the way, nationally renowned juvenile forensic psychiatrist, Dr. William Bernet from Vanderbilt University, assesses her situation. We meet Ellenette Brown, Cyntoia’s adoptive mother who talks about the young girl’s early years. Georgina Mitchell, Cyntoia’s biological mother, meets her for the first time since she gave her up for adoption 14 years earlier. When we meet Cyntoia’s maternal grandmother, Joan Warren, some patterns begin to come into sharp focus.Cyntoia wrestles with her fate. She is stunningly articulate, and spends the time to put the pieces of this puzzle together with us. Cyntoia’s pre-prison lifestyle was nearly indistinguishable from her mother’s at the same age. History — seemingly predestined by biology and circumstance — repeats itself through each generation in this family.Cyntoia is tried as an adult, and the cameras are there when she is convicted and sentenced to life at the Tennessee Prison for Women. After the verdict, Cyntoia calls her mom to tell her the news.In the end, we catch up with Cyntoia as she is adjusting to prison, and struggling with her identity and hope for her future.
